Auction Process and Transfer to Live Auction
By registering for, bidding in, or purchasing any item through this auction, participants acknowledge that Music in Action ("the Host") may, at its sole discretion, transfer any auction item from the online auction to a live auction.
Where an item is transferred to a live auction, the Host may either:
continue bidding from the highest valid online bid received for that item; or
withdraw the original item and offer a substantially similar item in the live auction, with bidding commencing at a level determined by the Host.
Participants acknowledge that placing an online bid constitutes a binding offer and that, unless and until an item is formally transferred to a live auction by the Host, the highest eligible bidder at the close of online bidding may be declared the successful bidder and required to complete the purchase.
The Host reserves the right to determine, at its absolute discretion, whether an item remains in the online auction, is transferred to a live auction, or is replaced by a similar item.
General
By registering for, bidding in, or purchasing any item through this auction, participants agree to be bound by these Terms and Conditions.
The auction is organised by the Host ("the Host") for fundraising purposes. The Host reserves the right to amend these Terms and Conditions at any time without prior notice.
The Host reserves the right to refuse registration, suspend bidding privileges, withdraw items, cancel bids, or disqualify participants where necessary to ensure the fair operation of the auction.
Payments
You may be required to enter card details to pre-authorise payment. The Host reserves the right to charge pre-authorised cards for outstanding invoices once the campaign has closed.
The Host may apply a service fee to cover transaction fees, administration costs, or other costs associated with running the event and auction.
Online payments are securely processed by Stripe. Payments are directed by Stripe to the Host. GalaBid does not hold any funds.
All purchases must be paid in full before any item, voucher, experience, certificate, or prize is released.
Ownership of an item transfers to the successful bidder only after full payment has been received.
Auction Format
The auction may consist of online bidding, live bidding, silent bidding, prize draws, or a combination of these formats.
The Host reserves the right to modify the auction format, combine online and live bidding, extend bidding periods, reopen bidding, or otherwise vary the auction process where necessary to maximise fundraising proceeds.
Online bidding may close before the live event. For any item continuing into a live auction, the highest valid online bid at the close of online bidding will become the opening bid at the live event.
The Host reserves the right to add, withdraw, amend, substitute, split, combine, or otherwise alter auction items at any time, including after the auction has opened.
Bidding
All bids are binding and cannot be withdrawn once submitted.
Bids must meet or exceed the minimum increment specified for each item.
The highest eligible bidder at the close of bidding will be deemed the successful bidder.
Where there is any dispute regarding a bid, the Host's decision shall be final.
The Host reserves the right to reject any bid that is believed to be fraudulent, mistaken, or otherwise invalid.
No bids will be accepted after the final close of the auction unless expressly authorised by the Host.
Auction Items and Experiences
All items are offered in good faith and are subject to availability.
Descriptions, photographs, valuations, and estimates are provided for guidance only. The Host does not warrant the accuracy of any description, valuation, provenance, quality, fitness for purpose, or condition of any item.
Experiences, tickets, accommodation, travel arrangements, lessons, services, and similar prizes may be subject to additional restrictions, availability, expiry dates, blackout periods, age requirements, or terms imposed by the donor or provider.
Successful bidders are responsible for any costs associated with redeeming prizes unless explicitly stated otherwise. Such costs may include travel, accommodation, insurance, visas, meals, taxes, gratuities, or personal expenses.
No auction item may be exchanged for cash unless expressly stated.
Collection and Delivery
Successful bidders are responsible for arranging collection of items unless delivery has been specifically offered.
Liability
To the fullest extent permitted by law, the Host, its trustees, employees, volunteers, sponsors, donors, and representatives shall not be liable for any loss, damage, expense, claim, or injury arising from participation in the auction or from the use, redemption, or enjoyment of any auction item or prize.
Nothing in these Terms and Conditions excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
Data Protection
Personal information provided in connection with the auction will be used for the administration of the event, processing payments, contacting successful bidders, and complying with legal obligations.
Data will be processed in accordance with applicable data protection legislation and the Host's privacy policy.
Final Decisions
The Host's decisions regarding the conduct of the auction, bidding disputes, eligibility, winning bids, prize substitutions, and interpretation of these Terms and Conditions shall be final.
By placing a bid, participants acknowledge that they have read, understood, and agreed to these Terms and Conditions.
